Iatrogenic crimes: issues of criminalization and criminal liability

Abstract

The article is devoted to the peculiarities of legislative regulation of iatrogenic crimes in the light of the latest reform of the criminal legislation of the Republic of Armenia. The author analyzed the term “iatrogeny”, differentiated crimes according to the characteristics of a special subject of the crime (medical worker) when performing professional duties, and conducted a comparative legal analysis with the Criminal Code of the Russian Federation. The author focused on the criminalization of acts in the field of reproductive cloning and eugenic experiments, justifying the need for legislative regulation of these crimes, taking into account the growing needs of modern medicine in conducting experimental research. The relevant laws of the Republic of Armenia containing norms and definitions used in constructing the group of crimes under consideration are also analyzed. Medical error and qualification issues based on the characteristics of a special subject of a crime are considered.
