Abstract

The article analyzes the stages of the application of compulsory medical measures that have not been investigated. There are two stages: a) adoption and b) consolidation of the decision on such measures At the first stage, a decision is made on their application or non-application. At the same time, the criminal legislation does not provide any indication of the circumstances taken into account when making the relevant decision. In other acts, there is no clear regulation of the conditions for the application of a specific measure. The second stage of the application of compulsory medical measures is not regulated by criminal legislation at all. The criminal procedure legislation does this, but it is inadequate.
