Abstract

The article examines the issues of delineation of the norms on liability for committing offenses provided for in Articles 167, 214 of the Criminal Code of the Russian Federation, Article 7.17 of the Code of Administrative Offenses of the Russian Federation. The author gives a legal assessment of specific cases of graffiti on urban infrastructure objects. In addition, the norms of regional administrative-tort legislation on the application of inscriptions, drawings in places not designated for these purposes are analyzed. A proposal is put forward to construct such a composition of an administrative offense as desecration of buildings or structures with the need to distinguish it from the composition of vandalism. Special attention is drawn to the fact that it seems necessary to construct the composition of a crime with administrative prejudice by introducing Article 214¹ of the Criminal Code of the Russian Federation.
