Mobilization measures in the legal regulation of labor: history and modernity

Abstract

The article considers a number of changes in the legal regulation of labor relations that occurred after the start of a special military operation in Ukraine. A number of decisions of the Government of the Russian Federation and amendments to the Labor Code of the Russian Federation were analyzed. A number of contradictions between by-laws and legislation have been identified. The lack of a system in reforming labor legislation in the new conditions was found. Namely, the changes made to labor legislation are in the nature of a reaction to emerging problems. At the same time, our country has a fairly rich experience in regulating labor relations in extreme conditions, including in a situation of severe sanctions pressure. The author used the list of signs of legal regulation of labor in the conditions of industrialization of the 30s of the XX century, allocated by I.Ya. Kiselev, and compared with the current state of affairs. It was revealed that modern mobilization measures in the field of labor law have quite few features with similar events of the 30s. At the same time, some similarities were found, in particular, the desire of the executive authorities to publish acts, the norms of which replace the provisions of the current legislation. An author's assessment of this practice was given, as well as proposals were put forward to improve the current legislation.
