Abstract

The article is devoted to the study of the issue of determining the appropriate type of legal proceedings when courts consider cases on awarding compensation for violation of conditions of detention in accordance with Article 227.1 of the CAS of the Russian Federation, studying in this context the problem of the ratio of compensation for moral damage and compensation for violation of conditions of detention or in a correctional institution. In the course of the analysis, attention is drawn to the existence of contradictions in judicial practice, which faces the problem of choosing the type of legal proceedings in cases of awarding compensation for violation of conditions of detention, the legal consequences of considering such claims in civil proceedings are investigated. The article also contains proposals for improving legislation.
